Terms of Service

The full terms for the Pixbench app and website: using the creative tools, permissions over content, purchases, data controls, service responsibilities and resolving a problem.

01

The service and this agreement

Pixbench: AI Video Generator is operated by FTS AND SONS PROPERTY LIMITED, Unit 53, Imex Trading Estate, Upper Villiers Street, Wolverhampton, WV2 4XA, United Kingdom. In these terms, “Pixbench”, “we” and “us” refer to that company, and “you” means the person using our app or website. The agreement covers https://www.pixbench.org, the Pixbench mobile app, its creative features and related support.

The app's creative features include image-to-video, text-to-video, video templates and AI image generation. Pixbench is currently in development for Google Play. This website introduces the app and provides information and support; it does not run a live generation service, accept payment or provide an available store download.

A feature or purchase may have additional conditions displayed in the app or checkout, such as its included benefits, usage limits or billing period. Those conditions supplement these terms for that feature or purchase. They must be read together with these terms and cannot remove rights that the law protects. A later website change does not rewrite an earlier purchase.

02

Who can use Pixbench

You must have the legal capacity and any permission needed to enter this agreement where you live. You must meet applicable minimum-age requirements and any age requirements displayed for the app by its distribution platform. Where the law permits use with a parent or guardian's agreement, that agreement must be obtained before use.

If you use Pixbench on behalf of an organisation, you must have authority to act for it and to submit its material. Your use must comply with the laws, intellectual-property rights, privacy requirements and applicable marketplace rules that govern it.

Do not use the service where doing so is prohibited by law or an applicable restriction. The availability of a website or an app listing is not a representation that every feature is offered or permitted in every location.

03

App use without a Pixbench sign-in

Pixbench does not require you to register or sign in. User identifiers and service records associated with use of the app are distinct from a registered login. A Google Play account used to obtain the app or make a purchase is maintained by Google; it is not a Pixbench login.

Take reasonable care of the device and app access you control. Make sure information you submit for a generation, support request or purchase enquiry is accurate and that you are authorised to submit it. Let support know if you suspect unauthorised use of your device-related service records or paid entitlements.

Local files and the information available to identify a previous app session can be affected by deleting app data, reinstalling the app or changing devices. Keep copies of creative results you need and relevant purchase references. Contact support about missing paid access rather than assuming that clearing local data will recover or cancel it.

04

Rights in the software and brand

The Pixbench software, interface, site design, branding, documentation and other materials supplied as part of the service are protected by intellectual-property laws. The relevant rights belong to us or to the people who license those materials to us. These rights are separate from the rights in the material you submit or generate.

We permit you to access and use the service for its intended creative functions, subject to these terms and the applicable feature conditions. This is a limited, non-exclusive permission to use the service, not a transfer of its underlying software, models, trademarks or other protected materials.

Unless we give permission or the law allows it, do not reproduce, distribute, sell, license or commercially exploit the app, its interface materials or our branding as your own product. Keep copyright and other ownership notices intact. Restrictions on copying the app do not, by themselves, prevent a permitted export of your own creative result.

05

Your inputs and generated results

Your material includes the prompts, source images, settings and other information you choose to submit. You retain the rights you already have in that material. You are responsible for having the permissions needed to use it, including copyright, privacy and likeness permissions, and for deciding whether it is appropriate to submit.

Generated results can contain mistakes, unexpected details or similarities to other work. Review each result before downloading, sharing, publishing or relying on it. A successful upload or generation does not confirm that an input or output is lawful or that another person's rights have been cleared.

Rights in AI-generated material depend on applicable law and the material involved. We do not guarantee that a result attracts copyright, is exclusive to you or can be used in every commercial context. Any specific restrictions displayed for a supplied template or other licensed component also need to be respected.

Do not present generated media as authentic evidence of an event or a person's actions when that would mislead others. Make disclosures about synthetic content where required by law, a publishing platform or the context in which you share it.

06

The permission needed to process your material

Submitting material gives us the limited, non-exclusive permission needed to receive, process, temporarily store and transmit it, produce the requested result and make that result available to you. We may also handle material to address a support or safety issue you raise. This permission is limited to delivering, protecting and supporting the service; it does not transfer ownership of your material.

Generation uses self-hosted systems under our operation. We do not send creative inputs or outputs to a third-party AI generation provider, and we do not use any user data to train AI models. Prompts, input images and generated images or videos are kept in the generation environment for no more than 48 hours.

The service is not a permanent archive. Download a result you want to retain while it is available. Separate records necessary for a transaction, support matter, security investigation or legal obligation are addressed in the Privacy Policy; they do not create an open-ended licence to keep creative files or use them for training.

You may send suggestions about Pixbench. We can consider and act on a suggestion without a payment obligation merely because it was submitted, but feedback does not give us ownership of unrelated work or permission to disclose private information. Do not include confidential third-party material in an unsolicited suggestion.

07

Content and activities that are not permitted

Use Pixbench for lawful creative work. Do not ask it to produce prohibited material, submit material that violates another person's rights, or use a result to carry out an unlawful or harmful activity. The following restrictions apply to inputs, outputs and the way you access the service.

  • Do not create or distribute child sexual abuse material, sexualised depictions of minors, non-consensual intimate imagery, sexual exploitation or pornographic content intended for sexual gratification.
  • Do not use the service for threats, harassment, hateful abuse, violent extremism, encouragement of self-harm or other content promoting serious harm to people.
  • Do not commit fraud, phishing, scams, deceptive impersonation or identity abuse, fabricate evidence or documents, or deliberately mislead people about civic processes.
  • Do not infringe copyright, trademarks, privacy, publicity or other legal rights. Obtain the permission required for another person's likeness and do not expose their private information without a lawful basis.
  • Do not introduce malware, attempt unauthorised access, interfere with another person's use, overload infrastructure or conduct security testing without permission.
  • Do not evade safety measures, purchase controls or usage limits; manipulate payment or entitlement records; or resell service access without permission.
  • Do not scrape or systematically extract service data, remove proprietary notices, or reverse engineer protected software or non-public systems, except to the extent applicable law expressly permits the activity.
08

Permission to install and use the mobile app

Subject to these terms and the relevant marketplace rules, you may install and use an authorised copy of Pixbench on a compatible device that you own or control. This permission is non-exclusive and does not let you transfer, sublicense or redistribute the app as a separate product.

Do not sell, rent, repackage, modify or distribute the app itself without permission, or remove its security and ownership notices. This does not restrict an activity that applicable law permits despite a contractual restriction, or rights granted by a separate licence for an included component.

Your device, operating system, internet connection and Google Play services have their own requirements. Connectivity charges are your responsibility. Updates may be necessary for security or compatibility; the requirements for an available release should be checked in the app's official distribution information.

09

Paid features, purchase conditions and usage units

This website does not publish prices or promise a particular paid plan. If paid features are available, the app and checkout identify the price, currency, applicable taxes, included benefits and important limits before you confirm a purchase. Make sure you understand the offer and are authorised to use the chosen payment method.

If an offer uses credits, diamonds or other in-app usage units, the purchase conditions explain the quantity, permitted uses, any expiry or periodic reset, and any eligibility restriction. Read those conditions carefully: subscription allowances and separately purchased units may have different rules. The terms shown for the offer govern the units you choose to obtain.

Usage units represent the access described in the applicable offer; their name alone does not promise a cash value, transfer right or particular number of generated results. We show the applicable generation cost and usage conditions before the relevant purchase or paid action.

Google Play's checkout, payment validation and transaction rules also apply to purchases processed through its billing system. Keep the order reference so support can investigate a missing benefit or incorrect charge. We do not need your full payment-card information or access to your Google account to begin an enquiry.

10

Renewing subscriptions and cancellation

If you choose an automatically renewing subscription, the offer identifies its billing period, recurring price, benefits and cancellation conditions before confirmation. It renews according to the terms you accepted unless cancelled through the applicable store process. If a trial or introductory offer is available, its duration and the later charge are also disclosed before you agree.

Manage a Google Play subscription through Google Play's subscription settings using the Google account that made the purchase. Cancellation normally stops future renewal while access continues to the end of the current paid period. Immediate cancellation, refunds or other outcomes may apply under local law or the store's rules; check the confirmation shown for your purchase.

Uninstalling Pixbench, clearing app data or requesting deletion of your Pixbench user records does not instruct Google Play to cancel a subscription. Cancellation and a refund request are separate actions. Changes to a recurring price or other material purchase conditions must follow applicable notice, consent and store requirements.

11

Refunds and corrections to paid access

Use the Refund Policy for a duplicate or unauthorised charge, missing paid access, failed paid feature or another purchase problem. A Google Play purchase can also be reviewed through Google's refund process. Eligibility depends on the transaction, the issue, the store rules and the consumer protections that apply to you.

When a platform confirms an approved refund or payment reversal, the corresponding transaction and paid entitlement may need to be corrected or withdrawn. The adjustment must relate to that purchase; a refund is not a general right to erase unrelated purchases or remove your statutory protections. Contact support if the store's confirmed result and your app entitlement do not match.

We may investigate evidence of payment manipulation or refund abuse and take proportionate steps to protect the service. Making a legitimate refund request or disputing an incorrect decision is not itself misuse. Nothing in these terms makes every digital purchase non-refundable or prevents a remedy required by law.

12

Stores, external links and operational services

Some parts of using Pixbench involve other providers, including Google Play for distribution and billing and operational services for website delivery, communications and measurement. The app uses Adjust for attribution and related measurement. The Privacy Policy explains the personal information involved and applicable choices.

These operational services are separate from AI generation. Their involvement does not mean that Pixbench delegates your generation request to an outside AI model or sends your creative inputs and outputs to a third-party AI generation provider.

An external website or store has its own terms and privacy practices. We do not control its content, decisions or availability, and a link does not endorse every statement on the linked site. We remain responsible for our own contractual and legal obligations and cannot use an operational provider's involvement to remove those obligations.

If we display an offer, promotion or information about another provider, check who supplies it and the conditions attached to it before participating. A third party is responsible for its own offer unless we expressly agree otherwise; our own promotional descriptions and commitments remain subject to applicable consumer law. An offer does not require you to accept unrelated marketing or tracking.

13

Privacy, confidentiality and AI data

Our Privacy Policy and AI Data Privacy page describe how information is collected, used, protected and removed. Read them alongside these terms. Agreement to these terms is not a substitute for a separate consent where data-protection law requires one, and it does not waive your privacy rights.

We limit access to information to the purposes explained in those notices. Creative material is handled to provide and support the requested service, not as a licence to publish your private inputs or use your data for AI training. Necessary operational disclosures and legally required disclosures are described in the Privacy Policy.

Pixbench does not perform facial recognition or extract biometric identifiers. A photograph containing a face may nevertheless contain personal information. Only supply images and other information you are entitled to use, and avoid sensitive or confidential material that is unnecessary for the requested creation.

14

Deleting your Pixbench user data

You can use the deletion option in Personal Settings to request removal of your Pixbench user data and service records. You can also email support@pixbench.org, including when you no longer have access to the app. Neither route requires creating a Pixbench login. The deletion page explains what information can help us locate the relevant records.

Save creative results you need before requesting deletion. Once data is erased, it cannot be recovered from the deleted record. A file you have downloaded or shared outside Pixbench is a separate copy and is not removed from your device or another service by this process.

Limited records may need to remain for accounting, payment disputes, security, fraud prevention or other legal requirements, as explained in the Privacy Policy. These exceptions do not permit ordinary continued use of records that should be erased and do not extend the routine generation-file retention limit.

Deleting Pixbench data does not delete your Google account, cancel a store-managed subscription or automatically request a refund. You can pursue a purchase question at the same time as a deletion request; support will distinguish the relevant records and purposes.

15

Restricting access or ending use

You may stop using Pixbench at any time, subject to any separate cancellation steps for a purchase. We may restrict a request or suspend or end access where reasonably necessary to address a serious breach of these terms, non-payment for the affected entitlement, fraud, a security threat or a legal requirement.

We limit our response to what is proportionate to the issue. Where appropriate and legally permitted, we will explain the restriction and provide a way to contact support about it. Urgent protective action may be needed before notice can be given, and details may be limited where disclosure would undermine security or violate the law.

When permission to use the service ends, you must stop accessing the restricted service. Relevant obligations concerning existing purchases, rights in material, lawful record retention and unresolved claims continue to apply where their purpose requires it. Ending access does not remove a refund, privacy right or other remedy that the law gives you.

16

Availability, updates and service changes

Features can require maintenance, security updates, technical changes or changes needed to meet legal and marketplace requirements. Availability can also be affected by network interruptions or events outside our reasonable control. We cannot promise uninterrupted operation or compatibility with every device, browser or operating-system version.

We may develop, change or discontinue features for legitimate product or operational reasons. Where a proposed change materially affects an existing paid entitlement, we will provide notice and any options required by the purchase agreement and applicable law. An urgent legal or security issue may require a change before advance notice is possible.

If a change or permanent withdrawal prevents us from providing what you have paid for, contact support about the appropriate remedy, which may include restoring the benefit, ending the affected purchase or a refund where required. A general right to update the service is not permission to keep payment for an unfulfilled obligation without addressing your rights.

17

AI limitations and service standards

AI generation is probabilistic. It can produce inaccuracies, visual defects, unwanted details or material similar to other content, and repeated requests can produce different results. No particular style, factual accuracy, originality or commercial outcome is guaranteed merely by submitting a request.

The website's concept artwork illustrates creative directions. It is not a guarantee that every user will receive those results, and it is not a record of an available app interface. Check the description of an available paid feature before purchasing it and review generated material before using it.

These limitations do not remove standards or guarantees imposed by consumer law. Where applicable, paid digital content must conform to its description and other legally required standards, and services must be provided with reasonable care and skill. Rights to correction, repeat performance, a price reduction or a refund remain available where the law provides them.

18

Our responsibilities and the limits of this agreement

We are responsible for loss or damage for which applicable law makes us responsible, including a failure to meet our contractual obligations. Nothing here excludes liability for fraud, fraudulent misrepresentation, death or personal injury caused by negligence, or another liability that cannot lawfully be excluded or limited.

For a consumer, responsibility for loss is assessed under the applicable rules, including whether the loss was reasonably foreseeable and caused by a failure for which we are responsible. A statement about AI uncertainty or interrupted availability does not excuse us from providing what was agreed or from dealing with a legally valid claim.

You are responsible for the way you choose to use or publish material and for reasonable precautions such as checking results and keeping exported copies. We do not assume responsibility for an independent publishing decision or loss caused solely by misuse beyond our control. This does not limit responsibility where our own conduct contributed to the loss.

Pixbench does not guarantee business revenue, audience growth or profits from generated work. If you use the service for a business purpose, the same absence of a promised commercial outcome applies, subject to any specific agreement and mandatory law.

19

Claims involving another person's rights

If material you submit or publish leads to a complaint about copyright, privacy, likeness rights or another legal right, you are responsible for your own unlawful actions and any liability that applicable law places on you. We may ask for relevant information or evidence of permission to understand a complaint and protect the affected people.

Where your deliberate unlawful conduct or material breach causes a third party to make a valid claim against us, we may seek recovery only for loss that applicable law allows us to recover from you. This is not an unlimited obligation to defend us or pay for every claim associated with use of the app, and it does not cover loss caused by our own breach or wrongdoing.

A report or allegation is not conclusive proof of infringement. Contact support if you believe a restriction was mistaken. Do not send illegal content or unnecessary private material; provide enough detail to identify the issue and explain your connection to it.

20

Governing law and resolving a disagreement

Please contact support@pixbench.org with the issue and any relevant purchase or generation reference so we can try to resolve it. An informal support request does not stop you from using a regulator, a store dispute process or a court when you are entitled to do so, and it does not suspend a legal deadline.

These terms are governed by the laws of England and Wales, subject to mandatory consumer protections that apply where you live. You retain the court rights and local legal protections that cannot be removed by contract. These terms do not impose compulsory arbitration or require a consumer to give up an available local court.

If a complaint concerns a store decision, that store's review route may also be available. Privacy complaints and requests follow the routes described in the Privacy Policy. We will not treat the use of a lawful complaints process as a breach of these terms.

21

Export controls and trade restrictions

You must comply with export-control, sanctions and other trade restrictions that apply to your use of the software and service. Do not use Pixbench to carry out a prohibited transaction or transfer, or enable access for a person or destination where that access would be unlawful.

We may limit access where necessary to comply with a legal restriction. Do not attempt to circumvent a restriction that applies to you or use another person or device to complete a prohibited transaction.

22

Electronic notices and records

We may provide service information and notices through the app, this website or an email exchange you initiate with support. A purchase platform may provide its own receipts and billing notices. Keep a copy of important purchase conditions, receipts and relevant correspondence for future reference.

Electronic records and confirmations may be used to record an agreement or communicate a notice where the law permits. We will use an additional form of notice if applicable law requires it. This section does not authorise marketing messages or replace consent required for advertising, tracking or other optional processing.

23

Rights that apply in your region

Your location and the type of purchase may give you rights concerning digital content, service quality, cancellation, renewal, warranties and refunds. Those mandatory protections take priority over a conflicting term. Store policies may provide additional options alongside your legal rights.

Where a statutory cancellation period applies, any request to begin supplying digital content or services before that period ends, and any effect on the right to cancel, must be handled through the applicable purchase process with the information and consent required by law. Reading this website or using its preview does not itself waive that right.

If a feature is faulty, misdescribed or not supplied as agreed, the review of your claim must consider those rights even when a store's ordinary discretionary refund period has passed. Contact support or use the relevant store process to explain the issue.

24

Reading these terms together

These terms, the applicable feature and purchase conditions, and the linked policies describe the arrangements for the service. Privacy notices explain information handling and do not create consent merely by being referenced here. Nothing in an entire-agreement provision removes binding information given before a purchase or other rights protected by law.

If a provision is invalid or unenforceable, the remaining terms continue to apply to the extent permitted by law. A delay in enforcing a term does not mean that the right to address a later breach has been waived.

You may not transfer permission to operate or resell the service to another person without authorisation. If we transfer the business or an agreement to a successor, that transfer must respect existing obligations, your privacy rights and mandatory protections; it must not be used to reduce a consumer's rights without a lawful basis. We will provide notice where required.

25

Updates and contact information

We may revise these terms to reflect changes in the service, legal requirements or the way it is operated. The date displayed on this page identifies the current version. Material changes will be communicated with any notice or fresh agreement required by law; an updated page does not retrospectively remove an existing purchase right.

For questions about these terms, contact support@pixbench.org. The service provider is FTS AND SONS PROPERTY LIMITED, Unit 53, Imex Trading Estate, Upper Villiers Street, Wolverhampton, WV2 4XA, United Kingdom. The support page explains how to describe a product, payment, privacy or content concern without sending unnecessary personal information.

26

Understanding and accepting the terms

Read these terms and the conditions shown for a feature or purchase before using it. When you accept the terms through the app or an applicable purchase flow, you agree to the conditions presented there. If you do not agree, do not proceed with the affected use or purchase.

Acceptance does not give us permission to train AI on your data, waive a right that cannot legally be waived, or replace a separate consent required by law. You can contact support for clarification before deciding to use the service.
